FitFormiq Procedure for Reporting Unlawful Content
1. How to submit a notice
- A notice concerning specific Content, a Product or an activity which the person submitting the notice considers unlawful should be sent to kontakt@fitformiq.com with the subject line „Unlawful Content”.
- The notice should include:
- an explanation of why the Content is unlawful and identification of the law or person’s right infringed;
- the exact location, for example the URL, the name of the Trainer, Product or Client, or an identifier enabling the Content to be located;
- the name or business name and email address of the person submitting the notice, except for notices concerning specified sexual offences against children where the law permits this information to be omitted;
- a statement that the person submitting the notice believes in good faith that the information is accurate and complete;
- available evidence and, where the notice concerns another person’s rights, proof of authority to act.
2. Review
- The Operator confirms receipt to the email address provided and reviews the notice in a timely, diligent, objective and non-arbitrary manner, taking into account the type of Content, urgency and personal safety.
- The Operator may request supplementary information. The absence of information enabling the Content to be located or the allegation to be assessed may prevent action.
- The Operator may leave the Content in place, restrict its visibility, remove it, suspend a Product, payment or Account, or preserve evidence. It applies a measure proportionate to the risk and extent of the infringement.
- The Operator informs the person submitting the notice of the decision and the available means of contesting it. A user affected by a restriction receives clear reasons, the basis and scope of the restriction, information on the use of automation, if any, and the method of appeal, unless the disclosure of information is prohibited by law.
3. Appeal and abuse
- The person submitting the notice or the user affected by the decision may, within 14 days, request reconsideration at kontakt@fitformiq.com, identifying the decision, grounds and evidence. Where possible, the matter is reviewed by a different person.
- Knowingly false, mass or repeated manifestly unfounded notices may result in restrictions on their handling and liability of the person submitting them.
- The Operator does not conduct general monitoring. Where it becomes aware of a reasonable suspicion of a criminal offence involving a threat to the life or safety of persons, it notifies the competent authorities in accordance with the law.
